Eze2fly acts as an “Intermediary” solely to assist customers in gathering travel information, determining the availability of travel-related products and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for facilitating travel requirements. You acknowledge that Eze2fly merely provides intermediary services in order to facilitate services to you. Eze2fly is not the last mile service provider to you and therefore Eze2fly shall not be deemed to be responsible for any lack or deficiency of services provided by any person or entity including airline, or similar agency).

ELIGIBILITY

The site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for the site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the site.

By using this website, you represent and warrant that:

You are responsible for entering the proper and accurate contact details including your name (as per Passport), email ID to ensure that we and the Airline (Supplier) can effectively communicate with you.

1. This Site is only for your personal use. You shall not copy, license, adapt, distribute, exchange, modify, sell or transmit any content or material from this Site, including but not limited to any text, images, audio, video or links for any business, commercial or public purpose.

2. You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

3. Eze2fly grants you a non-exclusive, non-transferable, limited right to enter, view, use and transact on this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way. Access to certain areas of the Site may only be available to registered members. To become a registered member, you may be required to answer certain questions and provide certain details. Answers to such questions and details is mandatory. 5. This site is for consumer use only. Any travel agent/tour operator/consolidator/aggregator should not use this site for individual/group bookings. In the event of bookings by any travel agent/tour operator/consolidator/aggregator through the Site are detected, Eze2fly reserves the right, including without limitation, to cancel such bookings immediately without any notice to such travel agent/tour operator/aggregator/consolidator and/or to withhold payments/commissions thereto. The various discounts and offers mentioned on the Site are applicable to the Consumer for the purposes of end use only.

6. You cannot use the Content and materials on this Site, including but not limited to audio, images, software, text, icons for any purpose.

PROHIBITED ACTIVITIES

As a User of the Site, you agree not to:

1. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

Eze2fly Rights

1. If you send any communications or materials to the Site by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, and will be treated by Company, as non-confidential.

2. Any material submitted to this Site may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted or used by Company anywhere in the world, in any medium, forever.

3. If your booking or account shows signs of fraud, abuse, or suspicious activity, BudgetTicket may cancel any travel or service reservations associated with your name, email address, or account, and close any associated Eze2fly accounts.

4. Eze2fly reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Eze2fly systems remain well-protected. Towards this end, Eze2fly may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.

5. If Eze2fly.com its sole and exclusive discretion, concludes that the said transactions are not or do not reasonably appear to be, authentic, enforceable or valid, then Eze2fly may cancel the said orders at any time up before the scheduled time of departure of the relevant flight booked through Eze2fly.

TRANSMITTED MATERIAL

1. Internet transmissions are never completely private or secure. You understand that any message or information you send to this Site may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card/debit card/bank information) is encrypted (send in code). Sending a message to Eze2fly does not cause Eze2fly to have any special responsibility to you.

2. Copying of part or all the contents of this Site without permission of Eze2fly is prohibited except to the extent that such copying/printing is necessary for the purposes of availing of the services.

Disclaimer and No Warranties

1. The material in this Site could include technical inaccuracies or typographical errors. Eze2fly may make changes/modifications or improvements on the Site at any time.

2. You acknowledge that Eze2fly is an intermediary and is not liable for any 3rd party (suppliers) obligations due to rates, quality, and all other instances, whether to any such subscribers or otherwise. You expressly agree that use of the services and the site is at your sole risk. It is your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the site or on the internet generally. Eze2fly does not accept any responsibility and will not be liable for any loss or damage whatsoever arising out of or in connection with any ability/inability to access or to use the Site.

LIMITATIONS OF LIABILITY

In no Event will we or our Owners, or Employees be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of your usage of this Site.

GENERAL PROVISIONS

1. You may book travel on Eze2fly.com to travel to certain destinations which involve greater risks than others, entirely at your risk as to cost and consequences.

2. Eze2fly requests you to consult local authorities and evaluate travel prohibitions, warnings, announcements, and advisories issued by them before booking travel to certain international destinations.

3. By offering for sale travel to particular destinations, eze2fly does not represent or warrant that travel to such point is advisable or without risk. Eze2fly does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.

4. Eze2fly reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any material posted herein, in any respect. Eze2fly shall have no obligation to take the needs of any User into consideration in connection therewith.

5. Eze2fly reserves its right to deny in its sole discretion any user access to this Site or any portion hereof without notice.

6. Eze2fly is not responsible to provide information on any change in flight schedules, cancellation, status of airline/hotel etc.

7. Reservations are not considered confirmed, until ticketed. Fares are dynamic in nature and probabilities of change in them exist. We will contact you if this happens. You can either receive a full refund of the order or pay the fare difference between the original fare and the new fare for issuing the tickets.

8. Eze2fly retains the right in its sole discretion to deny access to anyone to this site or to a section of the site and the services we offer, at any time without notice and for any reason, including, but not limited to, for violation of these Terms of Use.

PROMOTION CODES

• Eze2fly offers promotion codes from time to time which may be availed on the Site as a discount coupon. Users are advised that the promotional offer of using Promotion Codes for receiving discounts can be availed only if correct and full details (of the promotional code) are filled in at the time of making the booking. In case if the customer fails to enter the promo code before making the booking, the company shall not be liable to give any credit to the customer after the booking has been made.

• Considering there are multiple promotional offers running on the site, user can avail the benefit of only one offer at a time. No two promotional codes can be combined at the time of making a booking.

• Promotional discounts are applied only on the base amount. Discounts are not applicable for any additional components including taxes.

UNUTILISED TRAVEL BOOKINGS

• The User shall request eze2fly for any refunds against the unutilized or 'no show' air booking for any reasons within 30 days from the date of departure for the air ticket. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, and BudgetTicket as the case may be. No refund would be payable for any requests made after the expiry of 30 days as above and all unclaimed amounts for such unutilized or no show air booking shall be deemed to have been forfeited.

USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site.

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

GOVERNING LAW

This User Agreement and your use of the Site are governed by and construed in accordance with the laws of India and the Parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Guwahati.

You should write your Booking ID provided at the time of booking in all further communication with us regarding a particular issue. This enables us to help to resolve the grievance faster.

FORCE MAJEURE

There can be exceptional circumstances where Eze2fly.com (Ezefly Technologies Private Limited) and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, route and flight cancellations etc. or any other reason beyond the control of eze2fly (Ezefly Technologies Private Limited). If eze2fly.com (Ezefly Technologies Private Limited) has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to the User or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective service operators. The User agrees that eze2fly (Ezefly Technologies private limited) being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User has to contact the Service Provider directly for any further resolutions and refunds.

The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, eze2fly (Ezefly Technologies private limited)’s obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge Eze2fly (Ezefly Technologies Private Limited) from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.

In no event shall Eze2fly (Ezefly Technologies Private Limited) and be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.
